Legal Duties of Managing Brokers Series: ADVERTISING Part 2

SECTION 62-13-310(b) of the Brokers' Act requires that signs posted on a property by a licensee must contain the firm's name and that the firm's name must be the same size or larger than the name of the licensee.
SECTION 62-13-312(4) of the Disciplinary Rules set forth in the Brokers' Act prohibits licensees from engaging in misleading or untruthful advertising, including use of the term "Realtor" by a person not authorized to do so, or using any other trade name or insignia or membership in any real estate association or organization of which the licensee is not a member.
As a managing broker, one of your many duties is to supervise the advertising efforts of your affiliate brokers. This means that you must review and approve all advertising used by your affiliate brokers. The sections of the Brokers' Act referenced above are just a couple of the rules and regulations that apply to advertising.
