Change in the Law regarding Restrictions on Mobile Homes/Modular Homes

In Williams v. Fox, (Tenn., March 15, 2007), the Supreme Court held that a modular house was not prohibited by a restrictive covenant banning mobile homes. The Tennessee Court of Appeals had decided that there was not a distinction between modular homes and mobile homes and therefore a restriction against mobile homes also extended to modular homes.

The Tennessee Supreme Court has now changed the law. Stay tuned next week for why the Tennessee Supreme Court made this ruling and overturned the decision of the Tennessee Court of Appeals.
